1. Profile Information
1.1.1 The Act shall have exclusive responsibility for all Profile Information placed on the Website. The Act warrants and represents that all Profile Information shall:
1.1.2 be legal, honest, accurate and truthful and, without limit, shall accurately represent the prices, standard, specifications and details of packages and services offered;
1.1.3 be kept up to date and updated on a regular basis, including with information on any extraordinary (materially adverse) events or situations;
1.1.4 not infringe the copyright, design, privacy, publicity, data protection, trade mark or any other intellectual property rights of any third party;
1.1.5 not be obscene, libellous or defamatory of any person, company or organisation;
1.1.6 not be deliberately misleading, breach any applicable law or regulation or code of practice;
1.1.7 comply with any instructions issued from time to time by BookEntertainment about the use of the Website;
1.1.8 be remotely updated by the Act entirely at its own risk; and
1.1.9 be input only by someone who is authorised to do so by the Act.
1.2 The Act is not authorised to include on the Website any telephone number (including Skype address), contact details, icons or other references for direct contact, identifying the Act or its website in the Profile Information. Neither may any other websites be mentioned nor may any references be made to hyperlinks to any website of the Act or of any third party. In case the Act breaches this commitment, BookEntertainment shall suspend the service provided by the Act from the Website.
1.3 All questions and complaints from Customers accessing the Act Profile are the exclusive responsibility of the Act and shall be handled by the Act. BookEntertainment may at its sole discretion offer support services to a Customer or act as intermediate between a Act and a Customer but shall be under no obligation to the Act to answer or address any questions, queries or complaints raised by Customers.
1.4 In the event that the Act shall be called by BookEntertainment regarding the booking made by a Customer, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, BookEntertainment reserves the right to review any call information.
2. Availability and Calendar
The Act must ensure to keep their availability and calendars up to date by either 2 way Syncing with google calendar or manually updating their availability on BookEntertainment's extranet.
To prevent double bookings, the Act will get an email confirmation to accept or reject the booking. Acts that constantly reject bookings will be subject to a review and may be removed off the site.
3. Fee and booking procedure
3.1 In order to secure a booking the Customer shall be required to pay a deposit (the "Fee") or the full amount directly to the Act. BookEntertainment will take our agreed commission (including any taxes) at this first payment stage through our secure payment partner.
Except in BookEntertainment’s absolute discretion, the commission shall be non-refundable and retained in full by BookEntertainment and BookEntertainment will not be liable for any payments to the Act. The Act shall account for sales tax on the full amount paid by the customer.
3.2 The Extranet shows details of all Customers bookings.
3.3 The Act agrees to the recording of all telephone calls, both inbound to any BookEntertainment telephone number or telephone number of an affiliate or partner of BookEntertainment, and outbound from any BookEntertainment member of staff or member staff of an affiliate or partner of BookEntertainment.
3.4 By accepting the booking from BookEntertainment, the Act must honour the bookings made via BookEntertainment over direct bookings and provide any individual terms and conditions including the Acts own cancellation policy.
3.5 Once booking is confirmed on BookEntertainment, the Act is advised to invoice the Customer directly via email and attach any individual terms and conditions including the Acts own cancellation policy. The contract is between the Act and the Customer and not BookEntertainment.
3.6 Cancellations by the Client
Each act will send their own cancellation policy within their terms and conditions to the customer. If the Client cancels the booking then the Client will forfeit the deposit, and the act may directly invoice the client for cancellation fees owed. BookEntertainment is not responsible for collecting cancellation fees from clients.
3.7 Cancellations by the Act
3.7.1 The Act may not cancel the engagement unless the Act is unable to perform due to Force
Majeure, illness or strikes, and can provide reasonable proof. In such a situation the Act will
not be held in breach of contract by the Client, and as such, the Act may substitute a similar Act, subject to the Client's reasonable approval, failing which approval, the contract will terminate without obligation to all parties involved.
3.7.2 Any deposits received by the Act from the Client must be repaid in full by the Act, including the BookEntertainment. fee within 14 days of cancellation
3.7.3 In such cases of Force Majeure, illness or strikes, the Act should flag BookEntertainment. immediately so we can inform the Client, and, if required, try to find a replacement Act.
3.8 Changes to the Contract on the day
Wherever possible the Act should try to contact the Client using the messaging system or BookEntertainmnent. support team by flagging their booking to discuss the changes. If changes are not flagged on BookEntertainment, our team will not be able to assist. Any unavoidable changes to the contract schedule on the day must be agreed between the Client and the Act.
4.Payments, Refunds and Holding an Act
4.1 Payments
The Client has been given the option to pay 20% or 100% of balance. If the client pays 20% then the remaining balance of 80% will be automatically debited on the balance payment date displayed on your extranet.
4.2 Payment Provider
All payments are securely processed using our payment partner Stripe. You can view their terms and conditions on their website.
4.3 Refunds
Where applicable, refunds will be provided by the Act and are not the responsibility of BookEntertainment.
4.4 Holding an Act
Customers can use the Hold option within BookEntertainment, this allows the customer to pre-reserve the act on BookEntertainment only for the agreed times. If the customer does not proceed with the booking, the hold will be removed.
5. Communication with a customer
5.1 This terms & conditions state that all booking information and changes must be communicated via the BookEntertainment extranet and not via personal email, telephone, sms or 3rd party message apps. This will ensure all booking information and changes are recorded in one platform to provide support for both the Act and Customer if any issue occurs.
5.2 Disputes and Complaints
If there is a complaint or a dispute arising from the engagement, then it should be submitted in to BookEntertainment by using the ‘flagging’ system within BookEntertainment. BookEntertainment will try to resolve any such disputes to the satisfaction of both parties. BookEntertainment is not responsible for such disputes through whatever cause arising.
6. Pricing of services
The Act must agree to give BookEntertainment Rate Parity. Rate Parity means the same and/or better rates for their packages / services and any associated extras for the same dates and event types. The rates must be subject to the same and/or better restrictions and policies such as payment, booking amendment and cancellation policy as are available through booking with the Act directly and following the Act’s standard price list (that is the rate charged for customers booking with the Act direct). This includes any bookings made via the Act’s websites, apps, phone and other Entertainment Agents / Booking websites.
7. The order in which the Act Profiles are listed on the Website, (the "Ranking"), is determined unilaterally by BookEntertainment. This Ranking is automated and based on a number of factors including but not limited to: completeness of profile information, customer review score and total dates available. The Act is able to influence its own ranking positively by updating and amending factors that are under its control through the Extranet. As the Ranking is generated automatically, no claim may be made against BookEntertainment. by the Act in relation to the Ranking.
8. This agreement will be governed by Northern Ireland law and any disputes will be dealt with by the Northern Ireland courts, unless you reside in Scotland, England or Wales in which case it is subject to the exclusive jurisdiction of the courts of England and Wales or Scotland (as appropriate).
